De ontwikkelingen rond WikiLeaks voorman Julian Assange nemen bizarre vormen aan. Met eigen medewerking is-ie vandaag gearresteerd in Engeland. Aanleiding was een arrestatiebevel van Interpol met de aanklacht sex crimes.
Volgens Assanges advocaat Mark Stephens wordt Assange niet beschuldigd van verkrachting, maar van sex by surprise. Een overtreding die alleen Zweden kent en een maximale boete van 5000 kronen heeft. Da’s ongeveer 545 euro. Het lijkt met molestatie te maken te hebben. Vraag is of dat zwaar genoeg is voor een Europees arrestatiebevel.
Naar de werkelijke reden blijkt het gissen. Maar Zweden kent een in Europees verband uitzonderlijke juridische bescherming van vrouwen. Daarom hoeft er niet bij voorbaat aan Amerikaanse druk gedacht te worden. Toch blijft het merkwaardig dat een betrekkelijk lichte zaak tot een Europees arrestatiebevel kan leiden. Misschien is het chaotisch opereren van het Zweedse Openbaar Ministerie wel de werkelijke reden voor Assange’s arrestatie.
Marianne Ny is de Zweedse aanklaagster die het Europese arrestatiebevel heeft doen uitgaan. Wat de grond precies is wordt niet duidelijk, hoewel het gaat om verdenking van sexual crimes. Mevrouw Ny zegt de ondervraging van Assange in Zweden te willen voortzetten. Ze zegt geen tijd of mogelijkheid te hebben om Assange in Engeland te verhoren.
Ny verwijst voor de aanklacht mede naar Hoofdstuk 4, On Crimes against Liberty and Peace, sectie 7 van de Zweedse Strafwet die zegt: A person who physically molests or by discharging a firearm, throwing stones, making loud noise or other reckless conduct molests another, shall be sentenced for molestation to a fine or imprisonment for at most one year.

Rozenberg told Sky News that charges were read out to Assange. In one of the cases Assange was alleged to have had sex with a woman who was asleep, the court heard, according to Rozenberg. The other case allegedly involved coercion, he said."

Er doen zich allerlei verhalen daarover. De vrouwen die verkracht zouden zijn, zouden de volgende dag over hun sekspartij hebben opgeschept op sociale media en via SMS. Het is goed dat ie zich aangegeven heeft, want hoe sneller het verhaal achter de rug is, hoe sneller hij verder kan gaan.

The Many Fronts of the First Infowar

John Perry Barlow has made a call to arms (via Twitter): “The first serious infowar is now engaged. The field of battle is WikiLeaks. You are the troops.”
This is a little grandiose for my taste. But among the many interesting things going on here is the prominent role of nonstate actors. The battleground players include:
Domain name services: On the first day, a major denial of service attack was launched (apparently by a private party) against the Wikileaks site. Amazon dropped service to Wikileaks, but the “Swiss Pirate Party” picked it up. Lots of people have set up “mirror” sites in part as insurance in the event the main Wikileaks site gets taken down.
Payment systems: Paypal stopped processing payments to Wikileaks. Visa and Mastercard have followed this morning. The Swiss PostFinance Bank shut down a Wikileaks account.
Social media: As Kevin points out below, Facebook is keeping the Wikileaks page up. Wikileaks-supportive tweets continue at what appears to be a manic pace (many against as well). Some worry that Twitter is omitting the subject from its “trending topics”, which Twitter has denied. There’s even a brouhaha about whether Time has blocked Assange votes in its balloting for Person of the Year (apparently not – he’s enjoying a comfortable lead).
The possibility is that powerful private actors can shut Assange down, or at least are an important part of any effort to do so. That’s the noose that’s tightening. (See this Guardian timeline of attacks on Wikileaks – only a few are governmental.) All of this is at least nominally in the shadow of the law — those that have taken action against Wikileaks have cited legal justifications. But one wonders whether the legal arguments were window dressing for actions that would have been taken in any case. And I suspect that private actors who defy calls to cut Wikileaks off will not face legal action (Roger’s kind of argument notwithstanding).
On the other side of the field are Barlow’s troops. They have reacted furiously against the corporate moves. There have been calls to boycott Amazon and Paypal; although I’m pretty skeptical that these will have much traction, you can bet that they are monitoring the situation closely. “Internet activists” did take down the PostFinance Bank website (it’s still down now). The mirroring and other work-arounds may be effective, and it seems pretty clear that the 250,000 cables will all eventually see the light of day. Is that evidence of victory?
Of course the more traditional state-administered noose is now also tightening, albeit in an oblique way (through the non-Wikileaks, sex-crimes charges against Assange). “The authorities” of one description or another are clearly leaning on private actors to advance US objectives. The state is still the key player, but it can no longer fight these wars on its own.

Internet Company Had Hosted Wikileaks Website
WASHINGTON – Homeland Security and Governmental Affairs Committee Chairman Joe Lieberman, ID-Conn., Wednesday issued the following statement after Amazon.com decided to terminate its relationship with Wikileaks. After reading press reports that Amazon was hosting the Wikileaks website, Committee staff contacted Amazon Tuesday for an explanation.
“This morning Amazon informed my staff that it has ceased to host the Wikileaks website. I wish that Amazon had taken this action earlier based on Wikileaks’ previous publication of classified material. The company’s decision to cut off Wikileaks now is the right decision and should set the standard for other companies Wikileaks is using to distribute its illegally seized material. I call on any other company or organization that is hosting Wikileaks to immediately terminate its relationship with them. Wikileaks’ illegal, outrageous, and reckless acts have compromised our national security and put lives at risk around the world. No responsible company – whether American or foreign – should assist Wikileaks in its efforts to disseminate these stolen materials. I will be asking Amazon about the extent of its relationship with Wikileaks and what it and other web service providers will do in the future to ensure that their services are not used to distribute stolen, classified information.”
Voor zover ik kan nagaan heeft Wikileaks helemaal geen informatie gestolen, maar wordt het aangedragen door derden. Bemerk ook dat Lieberman een semantische drogreden gebruikt: "No responsible company". M.a.w. wie wel meewerkt is geen "responsible company"?
Nog een drogreden: een beroep op angst: "illegal, outrageous, and reckless acts". Vooralsnog echter, en dit wordt door Assange aangedragen, is er in de periode van de afgelopen vier jaar geen enkel aanwijsbaar slachtoffer gevallen door Wikileaks. Wel door Amerikaanse drones en geleide wapens. Maar da’s bijzaak.

@George: Ja verbaas jij je ook over dat gebruik van de term ‘molestation’? In het engelse (of amerikaanse?) taalgebruik betekent ‘molest’ meestal ‘misbruik’ (oftewel seksueel misbruik) en niet mishandeling (‘abuse’), hoewel het die betekenis ook wel heeft.

Bedankt voor jullie overpeinzingen. Er zit weinig lucht tussen onze meningen. In het Angelsaksische nieuws worden allerlei uiteenlopende termen gebruikt voor wat Assange uitgevreten zou hebben. Dat was me ook opgevallen, Joke. En in Nederland wordt dat dan weer ondertiteld als verkrachting, misbruik of welke termen dan ook. Alsof een olifant het ene moment een giraffe en dan weer een tijger genoemd wordt. Er is werkelijk geen peil op te trekken.
Je moet waarschijnlijk Zweeds zijn om ten volle te begrijpen wat de juridische positie van vrouwen extra bijzonder maakt. Ik vermoed dat we de komende dagen nog veel gaan horen van aanklaagster Marianne Ny en haar overwegingen. Dat er Amerikaanse druk is uitgeoefend op de Zweden lijkt vanzelfsprekend. Maar een en ander kan best synchroon lopen met wat Marianne Ny over de vervolgbaarheid van sex by surprise denkt. Het komt op mij als buitenstaander allemaal uiterst schimmig over. Sex by surprise, hoe verzinnen de Zweden het.

Het verhaal gaat dat in beide gevallen het condoom zou zijn geschuurd (wiki leaked) en dat Assangel zou doorgegaan met neuken zijn. Dat kan inderdaad voor verkrachting in aanmerking komen.

Het gaat natuurlijk niet echt om een verkrachting, aanranding, sexueel misbruik of ontbrekend condoom. Het gaat in de WikiLeaks uiteindelijk om het falen van de Amerikaanse regering om haar eigen informatie te beschermen. Voor vervolg zie nieuwe posting.
